Yes, and family lawyers do it. Sometimes the first call we get about a house comes from a lawyer rather than from either spouse, because the Flowers Team has already been named in the separation agreement as the agent who will handle the sale.
Sometimes those are clients we know. Sometimes we have never met them. When it is the second, it usually means one of two things. Both sides wanted a complete third party with no history with either of them, or both lawyers wanted the team with the strongest record in town on a sale that neither client wanted to argue about.
Naming an agent in the agreement solves a specific problem. Choosing one is another decision two separating people have to make together, and it arrives at the point where agreeing on anything is hardest. Settling it in the paperwork, alongside everything else being settled, takes the argument off the table before it starts. It also means neither of you can later say the other picked somebody who was on their side.
If you want us named, your family lawyer needs the full brokerage wording: the Flowers Team at Royal LePage Meadowtowne Realty, 475 Main St E, Milton, ON L9T 1R1, 905-878-6232. Give that to them before the agreement is drafted rather than after it is signed.
What such a clause does or does not oblige either of you to do is a question for your family lawyer, not for us. This page is general information rather than legal advice, and we will not tell you what your agreement means. If one of you is uncomfortable with an agent named in a draft, raise it with your lawyer while it is still a draft.
What does not change is how the file runs once it reaches us. A sale that arrives through a lawyer runs on exactly the same rule as one that arrives through a phone call. Facts about the house and the sale go to both parties at the same time. Personal commentary shared with us stops with us. We represent the sale, not one spouse against the other. That rule is the reason our name ends up in the paragraph in the first place, and changing it for a file that came in through a lawyer would defeat the point of naming us.
The first meeting also runs the same way. Being named in an agreement does not mean the sale starts before you are ready, and it does not mean you have engaged us. You still get the conversation, the opinion of value and the timeline before anything is signed.
The Flowers Team has handled 50 divorce-related transactions since January 2024 (Source: Flowers Team internal records, January 2024 to September 2026).
