Divorce

Can we both buy again after selling in a divorce?

Yes, and it is often two purchases rather than one. Some clients sell and both buy again. Others sell, rent for a defined stretch, and buy once custody and the financial arrangements are settled. Which path fits usually comes down to whether the separation agreement is signed.
Can we both buy again after selling in a divorce?

Yes, and it is often two purchases rather than one. A single sale at the end of a marriage frequently becomes a sale and two purchases, because both of you need somewhere to live.

How that happens splits along one line. Some clients sell and both buy again straight away. Others sell, rent for a defined stretch, and buy once custody and the financial arrangements are settled. Both are normal, and we run both regularly.

Which path fits usually comes down to the separation agreement. Most financial institutions want to see an executed or agreed-upon separation agreement before they will qualify either of you on your own. It is the most overlooked step in a divorce sale, and it is the whole reason the sell, rent, then buy path exists. What your particular lender will require is a question for your mortgage professional, and it is worth asking before the house is listed rather than after it sells.

The practical consequence is a sequencing one. If you know you want to buy again but custody and finances are not settled, it is too early to list. Renting for a defined stretch is not a failure of planning. For a lot of people it is the plan, and it is a considerably better outcome than selling into a purchase that falls apart on financing.

There is a timing question underneath all of this that people rarely raise until it is urgent. Two households have to come out of one closing, and the buyer of your house has a date of their own. We build the timeline around who is living in the house and where each of you is going next, rather than around what suits the buyer, and we negotiate the closing date accordingly.

What we can tell you before any of that is settled is what the house is worth today and what each of you would realistically be looking at afterwards in the Milton market. Two smaller purchases out of one larger sale is a different exercise from the move you made together, and it is better modelled early than discovered late.

We act on the purchases as well as the sale, for one of you or for both, and there is no expectation that you both use us. Some couples want the same team on all of it because it keeps the dates aligned. Others want a clean separation of everything, including the agent, and that is a reasonable thing to want.
