Divorce

Can we sell the house before the divorce is final?

Most of the sales we handle happen during the separation rather than after a divorce is finalized, and they proceed on the strength of your agreement or a court order. What often does have to come first is the separation agreement, and only if one of you intends to buy again straight after the sale. Talk to us and to your family lawyer about the order of events before you list.
Can we sell the house before the divorce is final?

Yes. A divorce order is not what a home sale waits for.

Most of the sales we handle close during the separation rather than after a divorce is granted. Nothing about listing, selling or closing requires the marriage to be legally ended first. What separation and divorce actually are, and which dates each one fixes, is set out in our post on legal separation and divorce in Ontario and is not repeated here.

Three things do have to be in place, and they make this a sequencing question.

Both spouses have to sign. On a matrimonial home in Ontario, one spouse cannot sell alone whatever the title says, unless the other has released those rights or a court has ordered the sale. That rule and its narrow exceptions are answered on their own page.

The proceeds have to have somewhere to go. A sale produces money on closing day, and how it is divided is settled by your separation agreement or by a court order rather than by the sale itself. Where neither exists yet, your lawyer holds the net proceeds in trust until one does. That is an ordinary arrangement rather than a sign that something has gone wrong, and it is what lets the house sell while the rest is still being worked out.

And if either of you is buying again, the financing has to be real. This is the part that catches people. A finalized divorce is rarely what a lender is asking for. The document that matters is the separation agreement, because most financial institutions want to see an executed or agreed-upon one before they will qualify one spouse alone. Waiting for a divorce order in the belief that it unlocks a mortgage is waiting for the wrong document. Whether a lender will qualify one of you before the agreement is signed is answered on its own page, and what that does to the listing date is answered on another.

Property is settled first and the divorce comes last, rather than the other way about, and family lawyers give the same advice for reasons that have nothing to do with real estate.

What we do about it is settle the order of events at the first meeting rather than at the offer stage. Which document each of you is waiting on, who signs what, and where the proceeds go on closing day are all answerable in an hour, and every one of them is cheaper to answer before the sign goes up.

The Flowers Team has handled 50 divorce-related transactions since January 2024 (Source: Flowers Team internal records, January 2024 to September 2026). Most of them closed while the couple was separated and not yet divorced.
