Divorce

Do our children have to change schools if we sell the house in a divorce?

Only if the new address is zoned to a different school. School assignment in Milton follows the address, so a move inside the same catchment changes nothing and a move outside it changes the designated school, even over a short distance. Confirm the new address on the board's locator before an offer goes in, because the answer is not negotiable afterwards. Schools are as per zoning to your home address.

It is the address that decides the school, not the neighbourhood name, not the postal code, and not how close the old school happens to be. A house four streets away can sit in a different catchment. A house fifteen minutes away can sit in the same one.

Two boards operate in Milton and they draw their boundaries independently of each other. The Halton District School Board runs the public schools and the Halton Catholic District School Board runs the Catholic schools, so one address can be zoned to a public school on one side of town and a Catholic school on the other. Both boards publish an address locator, and both treat it as the starting point rather than the last word. French Immersion, specialised programs and rural addresses can all be assigned differently from the home school, and the boards ask you to confirm those with their planning departments.

Milton’s boundaries also move. The town has added schools steadily as it has grown, and the public board runs formal boundary reviews when a new school opens or an existing one fills, with changes phased in over several years. Catchments in the newer parts of town have moved more than once. Any listing or neighbourhood page that names a specific elementary school for a specific street, ours included, is out of date the day a review closes, which is why we send you to the locator instead. The secondary picture has been steadier. Milton District High School, Craig Kielburger Secondary School and Bishop Paul Francis Reding Secondary School are the anchors families have planned around for years.

If the new address falls outside the catchment, staying at the former school is a request to the board rather than a right. It is decided case by case, busing generally does not follow it, and it is not something to build a purchase around.

For a separating family this cuts in a direction it does not for anyone else, because there are usually two next addresses rather than one. Two homes in one catchment means one school run, one set of buses and one set of neighbourhood friendships. Two homes in two catchments is a different logistics problem, and it is one your family lives with for years. That is worth deciding before either of you writes an offer.

So tell us early, roughly, where each of you expects to live next. It changes which houses we put in front of you. When in the school year to move, and how the listing is built around the parenting schedule, are covered in full in our post on co-parenting and real estate in Milton.
