Divorce

Can I get a mortgage before my separation agreement is signed?

Usually not. Most financial institutions want to see an executed or agreed-upon separation agreement, because they need the distribution of funds in writing and they need to know whether support will be paid or received, both of which change your income ratios. This is the most overlooked step in a divorce sale. Your mortgage professional confirms what your lender requires.
Can I get a mortgage before my separation agreement is signed?

Usually not, and this is the step that reorders a divorce sale more than any other.

Most financial institutions want to see an executed or agreed-upon separation agreement before they will qualify one spouse alone. They need the distribution of funds in writing, and they need to know whether support will be paid or received, because support in either direction changes the income ratios a lender uses to decide what you can borrow. That applies whether one of you is refinancing to buy the other out or buying a new home after the sale.

What any particular lender will accept, and at what stage, is not ours to state and we do not guess at it. Your mortgage professional owns that question. They are the person who tells you what one of you can carry alone, at what rate, with support counted the way lenders count it, and what has to be in hand before an approval means anything. Ask them early, before the two of you build a plan around an answer nobody has confirmed.

Two words in that sentence do the work: executed, or agreed-upon. Those are different stages, and which one is enough is a question for your lender rather than a rule. A separation agreement is only enforceable in Ontario if it is in writing, signed by both of you and witnessed, and our post on selling before or after the separation agreement covers what makes one count.

The risk is not that you get refused. Almost nobody is refused outright. The risk is that you sell the house on the strength of an approval issued when you were half of a two-income household, that approval quietly stops applying, and you close with nowhere confirmed to go. A pre-approval issued before the separation describes a household that no longer exists. Get requalified rather than assuming it carries over.

What we do about it is ask the question at the first meeting, before anything is listed. Is either of you planning to buy again soon after the sale? If the answer is yes, the agreement sets your timeline and the listing date follows it rather than leading it. If the answer is no, because both of you are renting for a while, nobody is qualifying for anything yet and this question does not gate the sale at all. When it is too early to list, and the sell, rent, then buy path, are answered on their own page.

The Flowers Team has handled 50 divorce-related transactions since January 2024, and in 2026, 1 in every 7 Flowers Team transactions involves a separating household (Source: Flowers Team internal records, January 2024 to September 2026). The order of events is where more of them go sideways than anywhere else.
