Can each spouse have their own real estate agent?

It is legal in Ontario and it is a mistake. Two agents from two brokerages on one property tells every agent and every buyer that there is a separation behind the sale and that the sellers are motivated, which costs you at the negotiating table. We assign two of our own agents to the file, one as each spouse's point of contact, on a single listing agreement with two designated representatives named on it. Two of our agents on one file costs you the same as one.
Can each spouse have their own real estate agent?

Yes, and there are two versions of it. One of them costs you money.

The version that costs you is each of you hiring an agent from a different brokerage to sell the same house. It is legal in Ontario and we will not take part in it. The moment two firms appear on one property, every agent and every buyer looking at that listing knows there is a separation behind it and knows the sellers have a reason to move. That information is worth money and none of it comes to you. It also splits accountability: two marketing approaches, two versions of what the market is saying, and nobody answerable for the result. If one spouse wants a second brokerage listing alongside us, we step back rather than take part, even when refusing means losing the client.

The version that works is two agents from the same team. When a separating couple wants a point of contact each, the Flowers Team assigns two of its own agents to the file, one per person. Both are at Royal LePage Meadowtowne Realty and both work the same listing toward the same outcome. It is one listing agreement rather than two. How that agreement is written, and how the two agents handle an offer once it arrives, are set out in full on our post about the arrangement.

It does not cost more. Two of our agents on one file costs you the same as one. The arrangement changes who each of you talks to, not what the sale costs you, and nothing about the cost of selling the house changes because a second agent from our team is assigned to it.

What changes is who you call. Each of you gets your own person to ask the awkward question and think out loud with, instead of feeling like you are sharing someone. The transparency rule does not bend inside it. Facts about the house and the sale still reach both of you at the same time, and what you tell your own agent in confidence still stops there.

Whether it is offered at all comes down to bench depth. A solo agent cannot do this and a small office rarely can. The Flowers Team is 16+ specialists and has been ranked #1 in Milton since 2009, which is what makes putting two experienced agents on one file an ordinary decision rather than a favour. The Flowers Team has handled 50 divorce-related transactions since January 2024 (Source: Flowers Team internal records, January 2024 to September 2026).

Ask for it at the first meeting. Setting it up at the start is far easier than changing partway through.
